Liability is mandatory in cases of intent, gross negligence, or injury to life, body, or health. The customer retains the right to withdraw from the contract. If unforeseen events alter the contract's economic significance, adjustments will be made in good faith. Top Light GmbH & Co. KG may withdraw if adjustments are economically unreasonable, with prompt notification to the customer.
A one-year warranty from the delivery date covers mirrors against staining or becoming blind without external influence. Valid claims allow for replacement only, expiring after one year. The warranty is valid only for indoor use with proper air circulation and non-aggressive mounting materials. Exclusions include damage from processing, chemical exposure, mechanical impact, or improper storage and care.
Compensation claims are excluded unless liability is mandatory, such as under the Product Liability Act or for intent, gross negligence, or injury to life, body, or health. Claims for breach of essential contractual obligations are limited to foreseeable damages unless intent or gross negligence is involved. The limitation period for claims follows statutory periods for product liability claims.
The customer is responsible for disposing of goods at their own cost after use, freeing Top Light GmbH & Co. KG from obligations under § 10 Abs. 2 ElektroG. If goods are transferred to third parties, the customer must ensure proper disposal. The obligation does not expire before two years after the end of use.
Disputes are exclusively under the jurisdiction of Herford, unless the customer is a merchant or public entity, in which case Top Light GmbH & Co. KG may also sue at the customer's location. German law applies, excluding the CISG.
Any deviations from these terms require written form. The contract remains binding even if individual provisions are legally ineffective, unless it imposes unreasonable hardship on a party.
